1. Agreement
These Terms govern your use of Moply at moply.app and in the Moply apps for iOS and Android (the “Service”), operated by ZUNNO WEB DESIGN LTDA (“we”, “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you accept these Terms on its behalf and confirm you can do so.
2. The Service
Moply helps cleaning companies (“Companies”) schedule cleanings, organize crews, work with customers through a portal, send quotes and invoices, and plan routes. Companies invite their employees and customers. Some features depend on the Company’s plan. We may improve, change or discontinue features; if we remove something important to a paid plan, we will tell account owners in advance.
3. Accounts
- Give accurate information and keep it up to date.
- Keep your password and sign-in codes private; you are responsible for activity under your account.
- Tell us right away at admin@zunnodigital.com if you suspect unauthorized use.
- You must be at least 18 years old to open a Company account.
4. Companies' responsibilities
A Company using Moply is responsible for:
- The information it enters about its customers, properties and employees, and having the right to use it.
- Getting the consent required by law before Moply sends its customers emails or text messages on its behalf, and honoring opt-out requests (for example under the TCPA and CAN-SPAM Act).
- Who it invites and what permissions it gives its users.
- Its prices, invoices, taxes and the services it provides to its own customers.
5. Plans and fees
Paid plans are billed as shown when you choose the plan. Fees do not include taxes unless stated. We may change prices with at least 30 days’ notice, starting with the next billing period. Unless required by law, fees already paid are not refundable. If fees are not paid, we may limit the account after notice.
6. Acceptable use
Do not use the Service to:
- Break the law or anyone’s rights, or send spam or messages people did not agree to receive.
- Upload malicious code or content that is unlawful, harassing or infringing.
- Access other Companies’ data, test or bypass security, or overload the Service.
- Copy, resell or reverse engineer the Service, except as the law allows.
7. Your content
You keep ownership of the information and files you put into the Service. You give us permission to host, process and display them only to provide and secure the Service and as described in the Privacy Policy. The Service itself, including the software, design and the Moply name and logo, belongs to us.
8. Text messages and notifications
The Service sends service messages by email, text message and push notification. Text messages are covered by our SMS Terms: message frequency varies, message and data rates may apply, reply STOP to opt out and HELP for help. Carriers are not liable for delayed or undelivered messages.
9. Other services
The Service uses and links to services run by others, such as maps, email and text delivery, and sign-in with Google or Apple. Their own terms apply to them, and we are not responsible for them.
10. Ending your use
You can stop using the Service at any time and ask us to delete your account (see Delete your account). We may suspend or close accounts that break these Terms or put the Service or other people at risk, with notice when reasonable. Sections that by their nature should continue (such as ownership, disclaimers and limits of liability) survive.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that route times, travel estimates or addresses from map providers are accurate.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.
13. Indemnity
If you use the Service for a business, you will defend and hold us harmless from claims arising from the information you enter, the messages you send through the Service, or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located there, unless the law where you live requires otherwise.
15. Changes
We may update these Terms. The date at the top shows the latest version; for important changes we will notify account owners before they take effect. Continuing to use the Service after that means you accept the new Terms.
